There is no regulated maximum attorneys' fee that may be charged. However, the Bankruptcy Trustee can review the fee agreement and can lower the fee if it is determined to be unreasonable. Our attorneys' fees for a Chapter 7 case will vary depending on the complexity of the case. Only after a careful analysis of your case will we be able to determine the appropriate fee. Rest assured, our fees are fair, reasonable and competitive. In addition to the attorneys' fee, the Court charges a filing fee in the amount of $299.00. The filing fee must be paid when the petition is filed with the Court.
The maximum attorneys' fee for an individual Chapter 13 filing is $3,000.00. For businesses, it is $4,500.00. In addition to the attorneys' fee, the Court charges a filing fee in the amount of $274.00, which must be paid when the petition is filed.
Sometimes, other issues may arise in your case, which are not covered by our agreed upon fee. For example, creditors may file an adversary proceeding claiming that your debt to them should not be discharged or they may try to "lift" the stay to foreclose on property or repossess an asset. In those types of instances, we would meet with you to determine whether you want representation for those issues. If you do, we would discuss and agree upon any additional fees for those services
